1) Acceptance
These Terms constitute an agreement between you and BERKWO TRAVEL LTD, a company registered in Uganda and trading as BerkwoTravel. By accessing berkwotravel.com or using BerkwoTravel services (the “Service”), you agree to these Terms. If you do not agree, do not use the Service.
2) Eligibility & accounts
- You must have the legal capacity to enter into a contract in your jurisdiction.
- You are responsible for safeguarding your account and for all activities under it.
3) Bookings & cancellations
- We connect travelers with tour operators/providers. When you book, you agree to any operator-specific terms shown at checkout.
- Cancellation and refund policies are disclosed during booking and in your confirmation. Some bookings may be non-refundable.
- Gorilla permits and special experiences: Certain bookings (such as gorilla trekking permits) may have stricter cancellation policies due to government regulations and limited availability. These will be clearly indicated at checkout.
- If an operator cannot fulfill a booking, your remedies are limited to those stated in the applicable policy.
4) Pricing, fees & taxes
Prices, service fees, currency conversions, and applicable taxes are shown (or estimated) at checkout. Final amounts may vary based on your payment method and currency provider.
- Dynamic pricing: Some services (such as airport pickups) may have dynamic pricing based on distance, time, or demand.
- Currency: Operators set prices in their local currency. Exchange rates are provided for reference and may differ from your bank's rate.
5) Payments
- Payments are processed by regulated third-party processors including Stripe, Flutterwave, and mobile money providers. BerkwoTravel does not store full card numbers or mobile money PINs.
- You authorize the processor to charge your selected method for booking amounts and applicable fees/taxes.
- Suspected fraud, chargebacks, or non-payment may result in cancellation or suspension.
- Refunds: Approved refunds will be processed to your original payment method. Processing times vary by provider (typically 5-10 business days).
6) User content
You grant BerkwoTravel a worldwide, non-exclusive, royalty-free license to host and display content you submit (e.g., reviews, messages) solely to operate and improve the Service. You represent you have the rights to submit such content.
7) Acceptable use
- No unlawful, infringing, deceptive, or harmful activity.
- No scraping, reverse engineering, interference, or unauthorized access.
- No posting of content that is illegal, abusive, or violates others’ rights.
8) Operators & partners
BERKWO TRAVEL LTD operates BerkwoTravel as a booking and mobility platform connecting customers with independent travel and transport providers in Uganda. BerkwoTravel facilitates booking, communication, and payment collection; the applicable operator or provider is responsible for delivering the booked service unless expressly stated otherwise.
Operators are independent third parties. BerkwoTravel is not a party to your contract with an operator unless expressly stated. Operator terms may apply to your booking.
- Tour operators are verified businesses or individuals offering travel experiences through our platform.
- Operators are responsible for the accuracy of their listings, pricing, and service delivery.
- BerkwoTravel facilitates communication and payment but does not directly provide tour services.
9) Disclaimers
The Service is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement, and do not guarantee uninterrupted or error-free operation.
10) Limitation of liability
To the fullest extent permitted by law, BerkwoTravel and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenues, data, or goodwill. Our aggregate liability for claims relating to the Service will not exceed the greater of USD $100 or the amounts you paid to BerkwoTravel for the booking giving rise to the claim.
11) Indemnification
You agree to indemnify and hold BerkwoTravel and its affiliates harmless from claims arising from your misuse of the Service or violation of these Terms.
12) Suspension & termination
We may suspend or terminate access for any violation of these Terms or risk to users, operators, or the Service.
13) Governing law & disputes
These Terms are governed by the laws of Uganda, without regard to conflict of laws rules. Disputes are subject to the jurisdiction of the courts of Uganda, except where applicable consumer law requires otherwise.
14) Changes to these Terms
We may update these Terms from time to time. Continued use after changes become effective constitutes acceptance.
